Terms of Service

Welcome to AI4Seniors. These Terms of Service ("Terms") govern your use of the AI4Seniors website and services at ai4seniors.info (the "Service"), operated by AI4Seniors, a service of Trike Flights, LLC ("we," "our," or "us"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who Can Use AI4Seniors

The Service is intended for adults, primarily seniors aged 65 and over, as well as the senior living facilities, skilled nursing centers, community centers, and businesses that serve them. By using the Service, you confirm that you are at least 18 years old.

2. The Service

AI4Seniors provides an AI-powered question-and-answer service designed for seniors, delivered through a white-label platform made available to participating facilities. The Service includes:

  • The AI Wizard — an AI question-and-answer tool accessible to residents and members of participating facilities, free of charge to end users
  • White-Label Facility Platform — a branded version of the wizard configured with each facility's logo, colors, name, and dedicated URL
  • Enhanced Modules — optional, specialized support packs a community may add
  • Sponsor Display — when a community has an active sponsor, that sponsor's information is displayed alongside the wizard experience

3. Facilities

For Senior Living Facilities, Skilled Nursing Centers & Community Centers

Facilities that offer AI4Seniors agree to the following:

  • No Monthly Fee with a Sponsor: When a community has an active sponsor, there is no monthly fee to the facility, and the Service is always free to residents.
  • Setup Fee: A one-time setup fee is charged at activation to cover white-label configuration, branding setup, and onboarding. Setup fees are non-refundable.
  • Optional Self-Funding: A facility may choose to fund the Service or an enhanced module itself at a stated monthly rate if it prefers to operate without a sponsor.
  • Billing: Fees are billed via a third-party payment processor. Facilities agree to keep valid payment information on file where a fee applies.
  • Cancellation: Facilities may cancel at any time. Cancellation takes effect at the end of the current billing period.
  • Branding Assets: Facilities grant AI4Seniors the right to use their provided logo, colors, name, and links solely for the purpose of configuring and displaying their branded wizard instance.

4. Sponsor Program

AI4Seniors is funded by local business sponsors, who pay AI4Seniors directly. The following terms govern the sponsor program:

  • Sponsor Fees: Sponsors pay AI4Seniors a monthly subscription — Premium (category-exclusive) or Standard (shared category) — plus a per-tap (pay-per-click) charge for each qualifying resident tap on the sponsor's link or action. A one-time sponsor setup fee also applies. Specific amounts are stated in the sponsor's separate written agreement.
  • Fair Billing: A sponsor is billed for at most one tap per resident, per sponsor, per day. Ordinary use of the wizard that does not touch a sponsor's link is never billed.
  • Category Exclusivity: Only one Premium (category-exclusive) sponsor is offered per category per community.
  • Sponsor Dashboard: Sponsors receive secure access to a dashboard where they may view their taps and spend, set and pause a budget, and submit changes to their message. Submitted content is reviewed and approved by AI4Seniors before it appears to residents.
  • Sponsor Visibility: When a sponsor is active, the sponsor's name, logo, and message are displayed alongside the wizard experience within that community.
  • Sponsor Vetting: AI4Seniors reserves the right to approve or decline any proposed sponsor or sponsor content. Sponsors must provide products or services genuinely relevant to the senior community.
  • Aggregate Data Only: Sponsors receive aggregate tap counts only. They do not receive individual resident identity, questions asked, or usage — except information a resident affirmatively provides by choosing a sponsor action (such as requesting a callback).
  • Module Sponsorship: A sponsor may fund an enhanced module so the community receives it free; sensitive modules carry a dignified "supported by" acknowledgment only.
  • Sponsor Agreements: Sponsors are governed by a separate written sponsor agreement. In the event of conflict between these Terms and a sponsor agreement, the sponsor agreement controls.
  • Not an Endorsement: Display of a sponsor's information does not constitute a recommendation or endorsement by AI4Seniors of the sponsor's products or services.

5. Not Professional Advice

AI4Seniors provides general informational responses only. The Service is not a substitute for professional advice, including:

  • Medical advice — always consult a licensed physician, pharmacist, or qualified healthcare provider
  • Legal advice — always consult a licensed attorney
  • Financial advice — always consult a licensed financial advisor, accountant, or tax professional
  • Mental health support — if you are in crisis, call 988 (Suicide and Crisis Lifeline) in the United States

Never make important decisions based solely on information provided by AI4Seniors. Always verify with qualified professionals.

6. AI Limitations

You understand and accept that:

  • AI responses may contain errors, inaccuracies, or outdated information
  • The AI may occasionally generate responses that sound confident but are incorrect ("hallucinations")
  • AI responses are not reviewed by a human before being shown to you
  • We do not guarantee the accuracy, completeness, or reliability of any answer

7. Acceptable Use

You agree to use the Service only for lawful purposes. You agree not to:

  • Use the Service to harass, threaten, or harm any person
  • Submit content that is illegal, fraudulent, or violates the rights of others
  • Attempt to interfere with, disrupt, or hack the Service
  • Use automated tools to scrape, copy, or extract content from the Service without permission

8. Intellectual Property

All content on the AI4Seniors platform, including text, graphics, logos, software, and the white-label wizard technology, is owned by AI4Seniors or its licensors and protected by copyright and other intellectual property laws. Facility branding assets remain the property of each respective facility.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect information.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT AI RESPONSES WILL BE ACCURATE OR RELIABLE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI4SENIORS AND ITS FOUNDERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, OR ONE HUNDRED DOLLARS (US$100) IF GREATER.

12. Indemnification

You agree to indemnify and hold harmless AI4Seniors from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms.

13. Termination

We may suspend or terminate access to the Service at any time for violation of these Terms. Facility or sponsor arrangements cancelled by either party take effect at the end of the current billing cycle.

14. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Continued use after changes are posted constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the United States and the State of New Mexico, without regard to conflict-of-law principles.
